    Biden Administration Changes Federal Position in Support of ACA in Pending Supreme Court Case

    In a letter from the Deputy Solicitor General to the Supreme Court dated February 10, 2021, the Biden administration reversed the position of the Trump administration and argued in favor of upholding the constitutionality of the entire Affordable Care Act (ACA) in the case pending before the Court.

    U.S. Supreme Court refuses to take up ACA case on an expedited basis

    On January 21, 2020, the U.S. Supreme Court refused to fast-track a review of requests appealing the Fifth Circuit decision holding the Affordable Care Act’s (ACA’s) “mandate” to be unconstitutional.

    Federal Appeals Court rules that mandate provision of ACA is unconstitutional

    On Wednesday, December 18, 2019, a 3-judge panel of the Federal Fifth Circuit Court of Appeals held that the “mandate” provision of the Affordable Care Act (ACA) is unconstitutional. The panel sent the case back to Judge Reed O’Connor of the Federal District Court in Fort Worth Texas to “conduct a more searching inquiry” into which of the law’s many provisions could survive without the mandate.

    PCG wins HIPAA contract in California

    PCG was recently awarded a one-year engagement with the California Department of Public Health (CDPH) to complete an independent Health Insurance Portability and Accountability Act (HIPAA) risk assessment. The purpose of this project is to perform an independent risk assessment to ensure CDPH fulfills State Administration Manual (SAM) and HIPAA risk assessment and management requirements.
